One app, one agreement

The agreement

These Terms of Use ("Terms") form a binding agreement between you and Uri Nachmias, an individual sole proprietor (referred to here as "we", "us", or "Pica Clipper"), and govern your use of the Pica Clipper macOS app and the picaapps.com website (together, the "Service").

By downloading, installing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

Geographic scope

The Service is available only in App Store regions where we have published it. See the app's App Store listing for the current list of supported countries. We do not offer the Service in the European Economic Area. If you are accessing the Service from a region where we do not distribute it, you are not authorised to use it, and these Terms are not drafted to satisfy that region's consumer-protection law.

For users in the United Kingdom and Switzerland, these Terms apply alongside any local consumer-protection law that cannot be excluded by agreement.

Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of legal majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

What Pica Clipper does and what it stores

Pica Clipper is a clipboard manager for macOS. While it is running it observes the system pasteboard and writes a copy of new items to a local history database inside its sandboxed application support container. The most recent 1,000 items are kept; older items are discarded automatically.

Items copied from apps that mark the pasteboard with a recognised "sensitive" or "transient" type identifier are never written to history. The full ignore list and the mechanism that backs it are described in the Privacy Policy and are user-configurable in Settings → Ignore.

  • Ownership. The items in your clipboard history are yours. We claim no rights over them.
  • Responsibility. You are solely responsible for the items you copy and for ensuring you have the legal right to store and use them.
  • Our access. We do not have access to your clipboard history. We have no way to recover lost items, restore deleted entries, or read your history.

Sensitive data in the clipboard

Clipboard contents are uniquely sensitive. Passwords, credit-card numbers, two-factor authentication codes, address book entries, draft messages, API tokens, and other private data routinely transit the clipboard. By using Pica Clipper you acknowledge that:

  • The standard sensitive-type markers Pica Clipper honours are set voluntarily by other apps. If an app you copy from does not set one of the recognised markers, Pica Clipper will capture the item. We have no way to detect that an item is sensitive in the absence of a marker.
  • The ignore list in Settings → Ignore is your primary tool for excluding apps you don't want Pica Clipper to capture from. Use it.
  • You should clear history regularly if you copy sensitive data, especially on shared or borrowed Macs.
  • We accept no liability for sensitive data that ends up in clipboard history.

Acceptable use

You agree not to use the Service to:

  • Capture, store, or process clipboard content that you do not have the legal right to possess (for example, copied credentials belonging to another person).
  • Monitor someone else's clipboard activity without their informed consent.
  • Use the Service on a device shared with users who have not consented to having their clipboard observed.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the limited extent expressly permitted by law.
  • Probe, scan, or test the Service for vulnerabilities, or breach any security measure, unless we have authorised you in writing.
  • Use the Service in any way that would cause us to violate the App Store Review Guidelines or our agreement with Apple.

We may suspend or terminate your use of the Service if you violate these Terms, without notice if the violation is material.

Subscriptions, billing & refunds

The Service is offered on a freemium basis:

  • The free tier provides core clipboard-history functionality with limits described on the in-app paywall.
  • A paid subscription ("Pica Clipper Pro") unlocks the features described on the paywall. The current price is shown on the paywall and may change; existing subscribers are billed at the price they originally accepted until they cancel.

Subscriptions are sold and managed through Apple, not by us. By subscribing you also agree to Apple's Media Services Terms:

  • Payment. Apple charges your Apple ID at confirmation of purchase.
  • Auto-renewal. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the period ends.
  • Managing or cancelling. Use macOS App Store → Account → View Information → Subscriptions.
Refunds

All refunds are handled through Apple's standard refund process at reportaproblem.apple.com. We do not issue refunds directly and cannot reverse a charge on Apple's behalf.

Third-party services

The Service interoperates with the following third parties, each governed by its own terms:

  • Apple Inc. (App Store, StoreKit, macOS pasteboard APIs). Subject to Apple's Media Services Terms and Privacy Policy.
  • Sentry (Functional Software Inc., USA), used only if you opt in, for crash diagnostics. Subject to Sentry's Privacy Policy.
  • PostHog (PostHog Inc., EU hosting), used only if you opt in, for anonymous product analytics. Subject to PostHog's Privacy Policy.
  • Google LLC, used to receive feedback you choose to submit through the in-app form. Subject to Google's Privacy Policy.

You are responsible for reviewing each third party's terms before relying on the Service.

Open-source notices

Pica Clipper incorporates open-source components. The full attribution list with licence text is available in the Service at Settings → Open Source and in the public LICENSES.md file in the project repository.

Warranty & liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT EVERY SENSITIVE-TYPE MARKER WILL BE HONOURED (BECAUSE WE DEPEND ON OTHER APPS TO SET THEM CORRECTLY), OR THAT YOUR CLIPBOARD HISTORY WILL BE PRESERVED. YOU ARE SOLELY RESPONSIBLE FOR REMOVING SENSITIVE DATA FROM HISTORY AND FOR BACKING UP ANYTHING YOU WANT TO KEEP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE, IN AGGREGATE, IS LIMITED TO THE AMOUNT YOU HAVE PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM (WHICH MAY BE ZERO), OR FIVE U.S. DOLLARS, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless Uri Nachmias and any successors or assigns from any claim, demand, loss, or damage (including reasonable legal fees) arising out of: (a) the items you capture into clipboard history; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any third-party right.

Apple-specific terms (App Store EULA)

You acknowledge and agree, in addition to the standard Apple Licensed Application End User Licence Agreement (the "Apple EULA"), that:

  • These Terms are an agreement between you and us, not between you and Apple. Apple is not responsible for the Service or its content.
  • Apple has no obligation to provide maintenance or support for the Service.
  • In the event the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you.
  • We, not Apple, are responsible for addressing any claims you or any third party have relating to the Service.
  • We, not Apple, are responsible for the investigation, defence, settlement, and discharge of any third-party intellectual-property infringement claim relating to the Service.
  • You represent that you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Termination

You may stop using the Service at any time by deleting the app. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms.

Changes

We may update these Terms when the Service changes meaningfully. Material changes will be announced inside the app on next launch and reflected in the "Effective" date at the top of this page.

Contact & governing law

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service will be brought exclusively in the competent courts of Tel Aviv-Jaffa, Israel.
